On 09.02.2021, the complaining fuel-truck owners filed the complaint under ref. no. 1238 before the Hellenic Competition Commission against the company under the name "HELLENIC PETROLEUM SOCIETE ANONYME" and the distinguishing title "HELLENIC PETROLEUM S.A." concerning an alleged infringement of Article 1 of Law 146/1914 on unfair competition. The complaint considered is assessed a) as not falling within the competence of the HCC in accordance with Article 37 (1) of Law 3959/2011 insofar as the issues raised in it concern a private dispute, and b) in the further alternative and for the sake of completeness, as manifestly substantially unfounded, as defined in Article 37 (2) of Law 3959/2011 as no grounds for establishing an abuse of this position through refusal to/disruption of supply in the more specific context of refusing to continue a business relationship, and subsequently one of the cumulative conditions of Article 2 (2) (c) of Law 3959/2011 is not met. For that reason, it is not necessary to examine the holding of a dominant position by the company complained of. Therefore, no further action will be taken in this case concerning the above complaint lodged by of the fuel-truck owners against the company under the name "HELLENIC PETROLEUM S.A.", on the grounds set out in detail in the Act no 4/2022, according to Article 37 (1) and (2) of Law 3959/ 2011.
