The Plenary of the Hellenic Competition Commission (HCC) will convene on November 23, 2021 to examine, upon the relevant Statement of Objections, an alleged infringement of Article 1 of Law 3959/2011 (“Greek Competition Act”) and 101 TFEU by ATHONIKI TECHNIKI SA (“ATHONIKI”) in the tender for the public infrastructure project “North Road of Crete - Gournes Chersonisos Part”.
According to the Statement of Objections, the HCC is advised to a) find an infringement of Article 1 of the Greek Competition Act and Article 101 TFEU by ATHONIKI for its participation, with another undertaking, which has filed a settlement application, in an agreement for the manipulation of the above tender, which consists in the prior determination of the contractor, the submission of covered bids and the adoption of a compensation procedure; and b) to impose a fine.
It is noted that the Statement of Objections is not binding on the HCC, which will issue its decision after it has taken into consideration all the evidence, as well as the arguments put forward by the implicated party.
