The Hellenic Competition Commission (HCC) in plenary will convene on Wednesday, June 8th, 2022, to examine - following the relevant statement of objections - the commitments proposed by the ELOMAS buying alliance group, regarding alleged infringements of Articles 1 Law 3959/2011 and 101 TFEU.
In particular, the HCC will assess whether the submitted commitments proposal is in accordance with the terms, conditions and procedure for the acceptance of commitments with respect to the alleged competition law problems. According to the SO, following the Directorate-General for Competition investigation, there is evidence of communication between certain members of ELOMAS not to open a shop in a geographical area operated by another member. These findings maybe interpreted as leading to the geographical allocation of markets.
According to the SO, the commitments proposed by ELOMAS are adequate to address the possible competition problems identified, leading to the immediate restoration of the conditions of effective competition in the markets concerned
It is recalled that the SO proposal is not binding for the HCC, which will decide taking into account the facts of the investigation and the views of the relevant parties.
